Please read these Terms & Conditions (“Terms”) carefully before using the PropInsight platform at propinsight.io (the “Service”) operated by PropInsight (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Service. By using PropInsight, you represent and warrant that you meet these requirements.

2. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your credentials and notify us immediately of unauthorized access.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we determine are being used fraudulently.

3. Subscriptions and Billing

Certain features of the Service require a paid subscription.

• Payment. Subscription fees are billed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis at the then-current rate.
• Free trials. We may offer limited free trials. At the end of a trial, your account will not be automatically charged unless you elect to subscribe.
• Cancellation. You may cancel your subscription at any time through your billing settings or by contacting us. Cancellation takes effect at the end of the current billing period; we do not offer prorated refunds for unused time unless required by law.
• Price changes. We may change subscription prices with reasonable notice. Continued use of the Service after a price change constitutes acceptance of the new price.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Reproduce, resell, or redistribute PropInsight data or reports without our written permission.
• Attempt to reverse-engineer, scrape, or extract data from the Service in bulk through automated means.
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Share your account credentials with third parties.

5. Intellectual Property

All content, features, trademarks, and software comprising the Service are owned by or licensed to PropInsight and are protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service. You may use the Service solely for your own personal or internal business purposes.

6. Data and Real Estate Information

PropInsight provides real estate data, deal analysis, and comparable property information sourced from third-party providers. We make reasonable efforts to ensure accuracy; however:

• No investment advice. The Service is an analytical tool and does not constitute financial, investment, legal, or tax advice. You should consult qualified professionals before making any real estate investment decision.
• No guarantee of accuracy. Real estate data changes rapidly. We do not warrant the completeness, accuracy, or timeliness of any data provided through the Service.
• Your responsibility. You are solely responsible for any investment or business decisions you make based on information obtained through the Service.

7. Third-Party Services

The Service integrates with third-party services including Google (Firebase Authentication, Analytics) and Stripe (payments). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROPINSIGHT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION — ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

10. Indemnification

You agree to indemnify and hold harmless PropInsight and its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorney’s fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or that we determine is harmful to other users, us, or third parties. Upon termination, your right to use the Service immediately ceases. Sections 5, 6, 8, 9, and 10 survive termination.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in a court of competent jurisdiction in the United States, and you consent to personal jurisdiction in such courts.

13. Changes to These Terms

We may update these Terms at any time. We will post the updated Terms on this page with a revised effective date. Your continued use of the Service after the effective date of any changes constitutes your acceptance. If you disagree with the revised Terms, you must stop using the Service.
